Gun Rights Advocates: Say No to Sotomayor

Yesterday, 26 gun rights advocates released a letter urging Senators not to confirm Justice Sotomayor’s appointment to the Supreme Court:

Earlier in a 2004 case, United States v. Sanchez-Villar, Sotomayor and two colleagues perfunctorily dismissed a Second Amendment claim holding that “the right to possess a gun is clearly not a fundamental right.” Imagine if such a view were expressed about other fundamental rights guaranteed by the Bill of Rights, such as the First, Fourth and Fifth Amendments.

The last sentence is key. Our legislators can’t pick and choose our rights from the Constitution or ignore it when they find it convenient. Our rights to bear arms are just as “fundamental” as any other right expressed in the Constitution.
